As regards the first set of dangers, it behooves us to remember that men can never escape being governed. Either they must govern themselves or they must submit to being governed by others. If from lawlessness or fickleness, from folly or self-indulgence, they refuse to govern themselves then most assuredly in the end they will have to be governed from the outside. They can prevent the need of government from without only by showing they possess the power of government from within. A sovereign cannot make excuses for his failures; a sovereign must accept the responsibility for the exercise of power that inheres in him; and where, as is true in our Republic, the people are sovereign, then the people must show a sober understanding and a sane and steadfast purpose if they are to preserve that orderly liberty upon which as a foundation every republic must rest.”

The ability to travel freely without need for government authorization is fundamental to a free society. Ed has reviewed meticulously the California Vehicle code from a unique perspective that first came to mind in driver education when the instructor referred to ‘driving’ as a privilege. Ed wondered why?
The most recent post on the We R Change Los Angeles website has a post of a success in court based on Ed’s work. During his research he found that the courts consistently held that the use of the highway is a ‘fundamental right’ while at the same time holding that driving is a privilege. By focusing on the distinction between a right and a privilege we can learn much about freedom.

Dan consulted the Vehicle code and the powers of arrest by a peace officer and it turns out that peace officers only have the authority to make an arrest without a warrant if they have probable cause to believe a public offense has been committed in their presence. A public offense according to 683 of the Penal code is a type of offense that warrants a criminal prosecution. But since infractions are not crimes, then it can’t be a public offense. Some of you may think “wait a minute, I’m not arrested when I’m given a ticket.” Oh yes you are. According to 40500 of the Vehicle code a traffic stop and issuance of a notice to appear constitutes an arrest, besides what happens if you refuse to sign the ticket? They’ll hall you off to jail.
